1. Acceptance of these terms

Access to and use of this Website (the "Site") is subject to the following terms and conditions, which you are deemed to have accepted in full by accessing the Site. If you do not wish to accept these terms and conditions you should leave the Site immediately.

2. General details about the Site and application forms.

2.1. The information on the Site is intended for those permanently resident in the UK. For the avoidance of doubt the UK comprises England, Scotland, Wales, Northern Ireland, the Isle of Man and the Channel Islands. Some products or services may apply to a more limited range and you should check the range meets your needs. For instance the Channel Islands and the Isle of Man have their own insurance regulator. 

2.2. The Site is provided for information purposes only and none of the information on the Site constitutes an offer to contract other than these Website Terms of Use.

2.3. Parts of the Site may include invitation or inducements for you to consider the products or services offered. It is totally your decision as to whether you respond to those invitations or inducements.

2.4. If you respond to an invitation or inducement by applying on line for a product or service then you will be judged to be making the offer to purchase.  It will then be up to the person to whom you made the offer as to whether that offer is accepted or rejected.

If the offer you make is in whole or in part also on behalf of another person then you should make certain that you have their full agreement to do so.

2.5. British Insurance wants to bring products and services to your attention however it is your decision alone as to whether you make any offer to purchase those products or services. 

We strongly suggest that you read all available information before making an offer. If the offer is to purchase an insurance policy then we strongly suggest you read the policy summary and policy wording to check the cover meets your needs.

2.6. Please remember that when completing an online application form for insurance you still have the same duty to advise and declare any material facts. A material fact is anything which could influence the underwriter in setting the terms or accepting your offer for insurance. If in doubt it is better to advise than not to advise. Failure to advise could result in the policy not paying out for a claim.

2.7. Please always check how the offer you have made will be accepted. For some products or services that may be direct on-line whilst for others you may have to wait for an e-mail confirmation or a letter.

This can be important if you intend to cancel an existing product/service as soon as the new product/service is in place. You do not want to cancel and then find that your offer for the new product/service has been rejected.  

Each provider is responsible for their own system in how they confirm and accept applications offers to purchase their products or services. British Insurance Limited accepts no responsibility for third party providers.

4. Availability

4.1 British Insurance Limited will endeavour to ensure that the Site is accessible for 24 hours a day. However, British Insurance Limited will not be liable if, for any reason, the Site is unavailable at any time or for any period.

4.2 British Insurance Limited will have the right to suspend access to the Site temporarily or permanently and without notice.

4.3 British Insurance Limited will not be liable for loss or damages arising in contract, tort or otherwise if the Site becomes unavailable or is suspended for any reason.

5. Liability, advice and accuracy of information

5.1 Information contained on the Site is provided for information purposes only and should not be construed or taken as being advice or recommendation about any product or service.

5.2. British Insurance does not warrant or guarantee any product or service provided by any third party and accepts no liability for a third parties’ product or service.

5.3. British Insurance Limited uses reasonable endeavours to ensure that any information we provide about products arranged through our own facilities is accurate at the date of publication.

However, because of the nature of the Internet, there may be circumstances in which errors or omissions in the information may occur which are beyond the reasonable control of British Insurance Limited. For example a) unauthorised access by a third party changing information or b) a change in tax law or c) an insurance provider changing a policy wording without giving us prior warning.

Consequently British Insurance Limited will not be liable for loss or damages arising, in contract, tort or otherwise, directly or indirectly from the use of or reliance upon any information contained on the Site, unless the inaccuracy of that information is as a direct result of an error or omission of British Insurance Limited.

Customers are requested to check the accuracy of any information they wish to rely on with British Insurance Limited before reliance is placed upon that information.

5.4. Where British Insurance displays information about services and products provided by Third Parties then we do so based on information provided to us by those Third Parties or others who we believe are authorised to provide such information.

We display all such information in ‘good faith’ based on a ‘display as received basis’. We may précis or reword such information in order to fit web Site constraints or web based technology or for search engine optimisation.

5.7. If any part of the Site provides access to your data or a product or service provided to you by the Site and you have been provided with a password to access that data, product or service then responsibility for safe guarding that password is your responsibility.

6. Email

6.1. There is no guarantee that any e-mail sent will be received by us, or that the contents of any such e-mail will remain private during Internet transmission. If you have any concerns, you may prefer to telephone or write to us instead.

6.2. We do use e-mail to confirm certain services. We do not enter bank details into e-mail we send to You. We will however use e-mails to provide confirmation of products or services purchased or enquired about or applied for.  There is no guarantee that the contents of any such e-mail will remain private during Internet transmission.

7. Copyright Licence

7.1 British Insurance Limited owns the copyright and any other rights in all other material available on the Site or has license from others to use such material.

7.2 You are only permitted to download and save one copy to your computer or print one copy of the information available on the Site as your record only provided that is a non commercial use unless you receive written consent from British Insurance Limited to download or print the information for other purposes or in other volumes. In this case the downloading or printing of that information will be subject to the conditions contained in that written consent.

8. Rights to change these Website Terms of Use and to withdraw the service

You agree that British Insurance have the right to amend these Website Terms of Use at any time. The terms applicable to your use of the Site will be those displayed at the time of use. We will not back date changes nor will we make changes act retrospectively. However we must be able to create new Website Terms of Use to meet changes in law, practice and offerings on the Site and those changes will then become the terms applying for persons using the Site from the date those new Website Terms of Use are displayed.

9. Right to withdraw the service

Where British Insurance Limited offers a free service (whether or not you need to sign up to such service) of the types listed below;

  • renewal reminder service,
  • product information service,
  • document access service,
  • record access service,
  • quick quote service,
  • access to policy summaries and policy wordings,
  • new or information service,
  • Diary service

then British Insurance Limited has the right to withdraw or amend that service at our discretion and without reason.

You should always retain a back up record to replace any of the above services if you were reliant on such services.

British Insurance Limited will not be liable for loss or damages arising, in contract, tort or otherwise, directly or indirectly from the withdrawal or amendment or failure of any service.

Please note that if you do receive a service and your contact details change then you need to advise us of that change.   

10. Severability and clauses not allowed

British Insurance have tried to be reasonable in drawing up these Website Terms of Use. However if any clause is found to be unenforceable then it is agreed that the following will apply;

  • the remainder of the Website Terms of Use will continue to operate provided that they are able to do so without the excluded clause and still have meaning,
  • the excluded clause shall be redrafted to meet the minimum requirements of the law and then reintroduced into the Website Terms of Use as if it had always been in these terms based on the redrafted words. Such redrafting shall only be allowed if the basic intention of the excluded clause can be maintained.

11. Applicable Law

The Site is established by British Insurance Limited in England, English Law shall govern its use at all times and in the event of a dispute, the relevant parties irrevocably submit to the exclusive jurisdiction of the English Courts.
